Asbestos Disease Claims — Compensation for Asbestos Illness

Last reviewed: June 2026 · EA Personal Injury Solicitors

You can claim compensation for mesothelioma, asbestosis, asbestos-related lung cancer or pleural thickening if you were exposed to asbestos through an employer's negligence. The three-year time limit normally runs from diagnosis, not exposure. Claims remain possible if the employer has closed, through its insurer or, for mesothelioma, the Diffuse Mesothelioma Payment Scheme.

TL;DR — Quick Summary

Key Points

  • Asbestos diseases can have a latency of 20-50 years between exposure and diagnosis
  • Mesothelioma claims can be brought urgently — contact us as soon as diagnosis is confirmed
  • Claims against defunct employers are possible via the employers' liability insurer
  • The Diffuse Mesothelioma Payment Scheme provides compensation where no employer can be traced
  • No win, no fee — if the claim succeeds, a success fee may be deducted from your compensation

Frequently Asked Questions

What asbestos-related diseases can I claim for?
You can claim for mesothelioma, asbestosis, asbestos-related lung cancer, pleural plaques, diffuse pleural thickening and pleural effusion. Each condition has its own legal and medical characteristics, and the compensation available varies considerably.
How long is the limitation period for asbestos disease claims?
Three years from the date of knowledge — when you knew (or ought to have known) you had a significant condition caused by asbestos exposure. Given the long latency of asbestos diseases (which can be 20-50 years), many claimants are diagnosed decades after their exposure but remain within the time limit.
Can I claim if the employer no longer exists?
Yes. Employers who exposed workers to asbestos were required to hold employers' liability insurance. Many of those insurers are still in existence and can be identified through the Employers' Liability Tracing Office (ELTO) and other databases. We have extensive experience in tracing defunct employer insurers.
What if I cannot identify which employer exposed me to asbestos?
In mesothelioma cases where it is impossible to identify the responsible employer, the Diffuse Mesothelioma Payment Scheme (DMPS) provides a payment for those who cannot establish civil liability. We can advise on eligibility for the DMPS.
Are family members who were exposed to asbestos via a worker's clothing eligible to claim?
Yes. Cases of secondary (or domestic) asbestos exposure — for example, wives who washed their husbands' work overalls — have resulted in successful compensation claims. The employer may be liable for foreseeable secondary exposure.
How quickly should I start an asbestos disease claim?
As soon as possible, particularly for mesothelioma and other serious conditions. Mesothelioma in particular is a fast-progressing disease and early legal action can ensure claims are resolved in time for the claimant to benefit. We can act urgently where necessary.
