Rehabilitation After Serious Injury — Securing Early Treatment

Last reviewed: June 2026 · EA Personal Injury Solicitors

Early specialist rehabilitation can significantly improve long-term recovery after a serious injury. The Rehabilitation Code allows defendant insurers to fund appropriate rehabilitation before the claim is resolved — separately from and without prejudicing the compensation claim. We engage proactively with rehabilitation from the earliest stage of every serious injury case.

Frequently Asked Questions

What is the Rehabilitation Code?
The Rehabilitation Code (2015) is an agreed framework between claimant and defendant personal injury lawyers and insurers. It provides for the early assessment and funding of appropriate rehabilitation for seriously injured claimants — funded by the defendant's insurer on a without-prejudice basis before liability is admitted — with the aim of maximising long-term recovery outcomes. The cost of rehabilitation under the Code is kept separate from the quantum of the compensation claim.
What types of rehabilitation can be funded?
Rehabilitation funded under the Code or through early interim payments can include: neuro-rehabilitation at a specialist unit, physiotherapy and occupational therapy, neuropsychology and cognitive rehabilitation, speech and language therapy, case management to co-ordinate care and rehabilitation, and vocational rehabilitation to support a return to work where possible.
Does accepting rehabilitation affect my compensation?
No. Rehabilitation funded under the Rehabilitation Code is entirely without prejudice to the quantum of the claim. The defendant's insurer funds reasonable rehabilitation without this being treated as an admission of liability or affecting the final compensation entitlement. It is separate from and additional to the compensation claim.
What is a case manager?
A case manager (typically a qualified nurse or occupational therapist with specialist experience) co-ordinates all aspects of the seriously injured claimant's rehabilitation, care, and community reintegration. They liaise with treating clinicians, therapy teams, the claimant's family, and the legal team. In serious injury cases, the cost of case management throughout life is a recoverable head of loss.
Can I choose my own rehabilitation provider?
Yes. While the Rehabilitation Code requires agreement between parties on the assessment and funding, the claimant is not obliged to accept a provider chosen solely by the defendant. We ensure that the rehabilitation arranged is appropriate for your specific needs and is delivered by suitably qualified and experienced providers.
