Interim Payments in Serious Injury Claims

Last reviewed: June 2026 · EA Personal Injury Solicitors

Interim payments let seriously injured claimants receive part of their compensation before the final settlement or court award, to fund urgent care, rehabilitation, accommodation and equipment. They are available once liability is admitted or a judgment on liability is obtained. We apply as early as appropriate so you have support while your claim progresses.

TL;DR — Quick Summary

Key Points

  • Interim payments provide funds before the claim finally settles or goes to trial.
  • Available where liability is admitted, judgment entered, or certain criteria met.
  • Fund care, rehabilitation, accommodation, equipment, and lost earnings.
  • No restriction on how the money is used — it's your compensation.
  • Paid by the defendant's insurer; deducted from the final award.
  • Multiple interim payments can be sought as needs develop.

Frequently Asked Questions

What is an interim payment?
An interim payment is a payment on account of the eventual compensation award or settlement, made before the case is finally resolved. It allows claimants with serious injuries to access funds for care, rehabilitation, accommodation, equipment, and other needs without waiting years for the final outcome of their claim.
When can an interim payment be made?
An interim payment can be made where: (1) the defendant has admitted liability; (2) judgment has been obtained against the defendant on liability (with quantum to be assessed); or (3) the court is satisfied that a claimant would obtain judgment for substantial damages at trial. Applications are made under CPR Part 25.
How much can be paid as an interim payment?
The court will order no more than a reasonable proportion of the damages likely to be recovered at trial. In practice, where liability is clear and the eventual award will be large, substantial interim payments can be obtained — enough to fund necessary care, rehabilitation, and urgent accommodation needs. Multiple interim payments may be obtained as the claim progresses.
What can interim payments be used for?
Interim payments can be used for anything arising from the injury — urgent care and support, rehabilitation at a specialist unit, accessible or adapted accommodation, specialist equipment (wheelchairs, communication devices), vehicle adaptations, and to replace lost earnings. There are no restrictions on how the money is spent, though the court must be satisfied the amount is reasonable.
Who pays interim payments?
The defendant (or their insurer) pays interim payments. The amounts paid are taken into account when the final settlement or judgment is reached — so the claimant does not receive more than their total entitlement.
