Asbestosis Claims — Compensation

Last reviewed: June 2026 · EA Personal Injury Solicitors

You can claim for asbestosis if your lungs were scarred by heavy asbestos exposure while working for an employer who failed to protect you. The three-year time limit runs from when you knew of the asbestos link, not from the exposure, so claims decades later are common. Industrial Injuries Disablement Benefit can be claimed as well.

TL;DR — Quick Summary

Key Points

  • Asbestosis is a prescribed industrial disease caused by cumulative asbestos fibre inhalation
  • Three-year limitation period runs from date of knowledge of the asbestos link
  • Asbestosis increases the risk of lung cancer and mesothelioma — medical monitoring is essential
  • Industrial Injuries Disablement Benefit (IIDB) may also be available
  • No win, no fee — if the claim succeeds, a success fee may be deducted from your compensation

Frequently Asked Questions

What is asbestosis?
Asbestosis is a chronic, progressive fibrosis (scarring) of the lung tissue caused by prolonged, heavy inhalation of asbestos fibres. It causes breathlessness, a dry cough and, in severe cases, significantly reduced lung function and oxygen saturation. It is a prescribed industrial disease.
How is asbestosis different from mesothelioma?
Mesothelioma is a cancer of the pleural lining; asbestosis is a scarring condition of the lung tissue itself. Both are caused by asbestos exposure. Asbestosis is associated with heavier cumulative exposure and typically a longer latency. Asbestosis also increases the risk of lung cancer.
Can I claim Industrial Injuries Disablement Benefit for asbestosis?
Yes. Asbestosis is a prescribed industrial disease for IIDB purposes. This is separate from a civil compensation claim and you should apply for it in addition to pursuing legal action. We can advise on IIDB alongside your civil claim.
How long do I have to make an asbestosis claim?
Three years from the date of knowledge — when you knew (or ought to have known) you had a significant injury caused by asbestos exposure. The date of diagnosis is often the trigger, though it may be earlier if symptoms and exposure were previously linked.
Can I claim if my employer has gone out of business?
Yes, in many cases. Employers have been required to hold employers' liability insurance since 1969. We use the Employers' Liability Tracing Office (ELTO) and specialist tracing agents to identify insurers for defunct employers.
I have asbestosis — am I at increased risk of other conditions?
Yes. Having asbestosis indicates heavy asbestos exposure, which increases the risk of asbestos-related lung cancer and mesothelioma. Regular medical monitoring is important. If you develop a further asbestos-related condition, this can be the subject of a further or amended claim.
