Whiplash Claims — Compensation Amounts and How to Claim

Last reviewed: July 2026 · EA Personal Injury Solicitors

You can usually claim for whiplash if a non-fault accident happened within the last three years. For drivers and passengers, compensation is fixed by the government whiplash tariff, from £275 to £4,975 depending on duration. Injuries lasting over two years, additional injuries, and claims by cyclists, motorcyclists or pedestrians are valued outside the tariff.

TL;DR — Quick Summary

Key Points

  • Official tariff amounts range from £275 to £4,975 depending on how long symptoms last
  • The tariff only applies to drivers and passengers — cyclists, motorcyclists and pedestrians are valued under the Judicial College Guidelines
  • Injuries lasting over two years fall outside the tariff and are worth substantially more
  • Lost earnings, treatment costs and other injuries are claimed in addition to the tariff
  • Three-year time limit from the date of the accident
  • No win, no fee — if the claim succeeds, a success fee may be deducted from your compensation

Frequently Asked Questions

How much compensation will I get for whiplash?
For accidents on or after 31 May 2025, whiplash injuries suffered by drivers and passengers of motor vehicles are compensated under a fixed statutory tariff, ranging from £275 for symptoms lasting up to three months to £4,830 for symptoms lasting 18 to 24 months (slightly more where there is an accompanying minor psychological injury). If your symptoms last longer than two years, or you were a cyclist, motorcyclist, pedestrian or horse rider, the tariff does not apply and compensation is assessed under the Judicial College Guidelines, which generally produces higher awards.
Is it worth claiming for whiplash?
Usually, yes. Even a modest tariff award is money you are legally entitled to, and many whiplash claims also include compensation for other injuries, lost earnings, treatment costs and vehicle-related losses that sit outside the tariff. If your injuries are more than minor, or liability is disputed, having a solicitor can make a significant difference to the outcome.
Does the whiplash tariff apply to cyclists, motorcyclists or pedestrians?
No. The statutory whiplash tariff only applies to adults who were drivers or passengers of motor vehicles. Cyclists, motorcyclists, pedestrians and horse riders injured in road traffic accidents have their whiplash-type injuries valued under the Judicial College Guidelines instead, which typically results in higher compensation than the tariff.
Do I need medical evidence for a whiplash claim?
Yes. Since the 2021 whiplash reforms it is not possible to settle a whiplash claim without medical evidence. You will be examined by an independent accredited medical expert who prepares a report on your injuries and prognosis. Your solicitor arranges this for you.
What if I had other injuries as well as whiplash?
Many people suffer additional injuries in the same accident — for example bruising, a wrist injury or psychological effects. These are valued separately from the whiplash tariff. Following the Supreme Court decision in Rabot v Hassam (2024), mixed injury claims are assessed by valuing both elements and adjusting to avoid double counting. Claims involving multiple injuries are one of the main situations where specialist advice adds real value.
How long do I have to make a whiplash claim?
You generally have three years from the date of the accident to issue court proceedings. Children have until their 21st birthday. It is best to start much earlier while evidence such as dashcam footage, CCTV and witness details is still available.
How long does a whiplash claim take?
A straightforward whiplash claim where the other driver admits fault often settles within 4 to 9 months. Claims involving disputed liability, longer-lasting symptoms or multiple injuries can take 12 months or more.
